The North Carolina State Bar shall assess administrative fees and actual costs to lawyers in connection with imposition of professional discipline and in connection with petitions for reinstatement, stay and show cause, as described below.  

  1. For cases in which the Grievance Committee imposes discipline, an administrative fee of $350.

  2. For proceedings before the Disciplinary Hearing Commission, actual costs incurred by the State Bar plus the following administrative fees:   

The Grievance Committee administrative fee of $350.

        PLUS

 For DHC cases in which discipline is imposed, $1500 per day for each day spent in a contested hearing.      

  1. For uncontested DHC cases in which discipline is imposed, $750. 

  2. For petitions for reinstatement from disbarment or suspension, $1500 per day for each day spent in a contested hearing in which the petition for reinstatement is denied OR in which the DHC panel imposes additional conditions for reinstatement.

  3. For petitions for stay of any portion of a suspension, $1500 per day for each day spent in a contested hearing in which the petition for stay is denied OR in which the DHC panel imposes additional conditions for the stay or extends the length of the stay.

  4. For petitions to show cause why a stay of a suspension should not be lifted and the suspension activated, $1500 per day for each day spent in a contested hearing in which the petition to show cause is granted, the stay is lifted and the suspension is activated in whole or in part OR in which the DHC panel imposes additional conditions for the stay or extends the length of the stay. 

“A day spent in a contested hearing” is a full day or any fraction of a day in which the DHC hearing panel calls a hearing to order.  

“An uncontested DHC case” is a case in which the DHC hearing panel enters a consent order of discipline and does not call a hearing to order.

Pursuant to 27 NCAC 1D.0903(a)(1)(C), any lawyer who fails timely to pay the administrative fees and costs assessed will be subject to have his or her license to practice law suspended.
