Job Title: Trust Account Compliance (TAC) Program Paralegal
Department: Office of Counsel
Titles of Immediate Supervisors: Trust Account Compliance Counsel and the Director of Operations, Office of Counsel
Positions Supervised: None
Purpose of Job: To provide accurate, timely, enthusiastic paralegal support to trust account compliance counsel in administration of the Trust Accounting Compliance (TAC) Program and to provide accurate, timely legal support to the Office of Counsel.
Essential Job Responsibilities:
- Organize, prepare, track, and maintain electronic and paper trust accounting compliance program files and efforts to obtain compliance with program requirements; keep files and tracking system organized and updated
- Take initiative to learn and understand the disciplinary process of the NC State Bar and self-regulation
- Knowledge of court system and procedures, legal terminology, and civil procedure
- Develop an understanding and knowledge of the Rules of Professional Conduct, especially Rule 1.15 and its subparts
- Develop an understanding and knowledge of the regulation governing the trust accounting compliance program
- Prepare general correspondence and associated materials as needed
- Read, analyze, and summarize grievances; draft substances of grievance
- Read, analyze, and summarize responses to letters of notice; draft reports of counsel
- Maintain grievance files for assigned deputy counsel; keep files organized and updated
- Maintain status of grievances in case management software
- Assist with administrative tasks and communications to include corresponding with lawyers, defendants, witnesses, and various court personnel including court reporters
- Answer complainant and respondent phone calls
- Initiate calls to respondents and summarize the conversation in the form of a written memo
- Prepare subpoenas
- Assist deputy counsel(s) to prepare for depositions and hearings by organizing case files, performing research, and gathering and organizing all evidence and materials to prepare exhibits
- Assist deputy counsel(s) in drafting complaints and other pleadings to be filed with the Disciplinary Hearing Commission or other tribunals
- Assist deputy counsel in scheduling committee meetings, corresponding with committee members, and drafting meeting minutes
- Be able to work in a fast-paced environment and meet established deadlines with an accurate and complete final product
Non-Essential Job Responsibilities:
- Legal research on LexisAdvance and the Administrative Office of the Courts – Criminal and Civil websites
- Perform criminal record checks
- Assist with research projects
- Back up for reception
- Any other task as assigned
Accountability and Authority:
The TAC Program paralegal reports to and is directly supervised by the trust account compliance counsel and the director of operations for the Office of Counsel and indirectly by the counsel. The TAC Program paralegal will work collaboratively with the TAC Program investigator and paralegals in the Office of Counsel. The TAC Program paralegal is accountable for accurate and timely completion of all job responsibilities.
Desired education, experience and skills:
- High School diploma; college degree preferred
- 1-2 years of experience as a paralegal preferred
- Litigation paralegal experience preferred; paralegal certificate desired
- Proficient in Microsoft Office applications, including Word, Excel, and PowerPoint
- Communications skills: must have excellent writing and proofreading skills and the ability to format in Word, Excel, and Adobe Acrobat; articulate, uses correct grammar and spelling
- Strong organizational and analytical skills
- Ability to review many types of written material and summarize key information accurately and efficiently
- Ability to comfortably perform mathematical functions, specifically addition and subtraction
- Attention to detail is imperative
- Motivated to work enthusiastically as part of a team with supervising lawyers, investigators, and administrative staff
Working Conditions:
- Position is non-exempt in accordance with the Fair Labor Standards Act
- Hours: 9:00 a.m. to 5:00 p.m. Monday-Friday, one hour lunch break
- Overtime: occasional, required during quarterly meetings, paid or compensatory
- Travel: seldom
